Prohibition of mooring during severe weather alert
Considering that the maritime public domain is not a shelter during severe weather events such as strong northern swells, storms, or hurricanes, the following articles must be respected:

ARTICLE 1: Upon the announcement of an ORANGE alert by the competent authorities, owners or caretakers of vessels or any other property located in the maritime public domain, who do not have the possibility to secure the vessels or other property, must evacuate the area with these vessels or other property to seek shelter.

ARTICLE 2: Upon the announcement of a VIOLET alert, indicating strict confinement, all movement is strictly prohibited in the maritime public domain.

ARTICLE 3: Upon the return of a GREEN alert, indicating the end of the event, owners or caretakers of vessels or any other property may return to the maritime public domain.

ARTICLE 4: Owners or caretakers of vessels or any other property located in the maritime public domain, who have not complied with the conditions of Articles 1, 2, and 3 of this order, will be solely responsible for any damages that occur to their vessels or other property, as well as any damages caused by their vessels or other property to the port facilities and any other public or private infrastructure located on the coast.

ARTICLE 5: All users and captains must compulsorily identify and register with the port authority when entering the administrative limits of the Port of Saint-Martin, namely the bays of Marigot, Galisbay, Cul-de-Sac, Grand-Case, and Simpson Bay Lagoon.

ARTICLE 6: This order will be disseminated and displayed in marinas, at the Maritime Station, at the Port of Galisbay, and transmitted to the Prefect delegated to the representative of the State in the collectivities of Saint-Barthelemy and Saint-Martin.

ARTICLE 7: This order may be subject to a gracious appeal to the President of the Collectivity within two months following its notification. It may also be subject to a contentious appeal to the Administrative Court within the same period or, if applicable, within two months following the rejection of the gracious appeal.

ARTICLE 8: The President of the Territorial Council, the Interim Director General of Services, and the Director General of the Port Authority of Saint-Martin are responsible, each within their respective scope, for the execution of this order.
